Most clients leave everything to their spouse and use a system called per stirpes so that children get an inheritance. If real estate is owned, we recommend recording a Transfer on Death designation affidavit which is legally effective only once the owner(s) are dead so that probate is avoided.

Wills: A will is a document stating your intention for how you want your property to be distributed to your heirs.
Trusts: Trusts can take the place of or supplement a will. A trust manages the allocation of property by giving its benefits to many individuals and can be used while an individual is still living. Trusts become more useful for high-value estates and tax avoidance. If there is a possibility that a minor would inherit, a contingent trust is created. We also create trusts for people with special needs.
Health care directives: Include Healthcare Power of Attorney and living wills, these documents express how you would like to be treated in different medical situations.
Living Will: Describes end of life instructions.
Power of attorney: Granting a power of attorney to an individual allows them to act on your behalf in various business and legal matters.
Healthcare Power of Attorney: Designates who can make healthcare decisions for you when you are incapacitated. We use Ohio’s standard Healthcare Power of Attorney.
Financial Power of Attorney: Designates who can make financial decisions for you when you are incapacitated.
Transfer on Death Designation Affidavit: Affidavit which is recorded with deeds to avoid probate. Upon filing of the death certificate of the owner with the county Recorder, it directly transfers ownership of real estate.
